On May 15, 2023, the regulation of the Minister of Family and Social Policy of May 11, 2023, amending the regulation on employment certificates, was published in the Journal of Laws. The regulation of the Minister of Family and Social Policy of May 11, 2023, amending the regulation on employment certificates, published in the Journal of Laws on May 15, 2023, will enter into force 7 days after the announcement, which is May 23, 2023.
The change in the employment certificate is a consequence of recent amendments to the Labor Code, introducing remote work or exemption from work due to force majeure. The updated employment certificate template includes sections that allow employers to provide information regarding, among other things, the number of days of occasional remote work. The following additions have been made:
Item 1) The number of days or hours of exemption from work according to Article 148(1) § 1 of the Labor Code, i.e., exemption due to force majeure, utilized in the calendar year in which the employment relationship ceased (2 days or 16 hours per year).
Item 3) The number of days of parental leave utilized in the calendar year in which the employment relationship ceased (5 days per year).
Item 10) The number of days of occasional remote work provided for in Article 67(33) § 1 of the Labor Code, in the calendar year in which the employment relationship ceased (24 days per year).
Employers must remember to use the new employment certificate template from May 23, 2023.
