Conducting enforcement from premises not meeting the requirements of a separated premises within the meaning of the Act on ownership of premises – in terms of the resolution of the Supreme Court of December 8-th 2017, Ref. no. III CZP 71/17.
The given issue was a legal issue considered by the Supreme Court in the case, reference number III CZP 71/17.
The dispute applied to the purchase, at the auction, of an apartment located in the tenement house. For the given premises, based on the agreement on the establishment of a separate ownership of the premises, a mortgage register was established , however, in a later period the above-mentioned contract was annulled due to the fact, that the premises have separate ownership within the meaning of art. 2 paragraph 2 of the Act on the Ownership of premises.
The above-mentioned case was considered by the regional court, who had doubts if conducting the execution from such premises would be possible and decided to appeal to the Supreme Court with the following legal question:
Is it acceptable to carry out the execution from a property constituting a separate property of the premises for which the mortgage register has been established, in a situation when the premises did not meet the requirements of a separate ownership of premises (within the meaning of art. 2 of the Act of June 24-th, 1994 on the Ownership of premises) at the time of establishing its separate ownership as well as establishing its mortgage register??
In response to the above-mentioned legal question, the Supreme Court, on December 8-th, 2017, adopted a resolution according to which:
It is not acceptable to carry out the execution from the property, if according to legally-binding court decision, due to failure to meet the requirements referred to in art. 2 paragraph 2 of the Act of June 24-th 1994 on the Ownership of premises (consolidated text Dz.U. 2015.1892 as amended), the invalidity of the agreement to establish a separate ownership of the premises was verified.
Therefore, Supreme Court has decided that if we are dealing with premises where separate ownership is not established, within the meaning of the Act on the ownership of premises (also in the event of a subsequent annulment of the contract establishing separate ownership), it is not possible to conduct executions from such premises.
